Over fitting

Let's say you are looking at a model to predict appendicitis.   The model states that if the patients has a normal WBC count, no fever, no vomiting and no anorexia than the probability of appendicitis is <1%.   The rule was derived on a sample of 500 patients.  To avoid data over fitting they should have had at least 40 cases of appendicitis in this sample.
